The present work is situated within the framework of study of the national and international regulations on human rights and aims to analyze the motivations, the jurisprudential lines and the practical consequences of the ruling. It is based on the hypothesis of considering that the decision in this regard is exceptional. It is a qualitative, analytical, documentary, microsocial investigation with a diachronic temporal scope, which seeks, through the study of the rulings of our Highest Court, to elucidate whether the ruling in question could be a contribution in order to promote the transformation of the "Argentine union model". For this the thesis explores: Freedom of association (Chapter 1); The Argentine union model (Chapter 2), The discriminatory dismissal for union reasons (Chapter 3) and The Orellano case (Chapter 4).
Según lo resuelto por la Corte Suprema de Justicia de la Nación en la causa "Orellano", la titularidad del derecho de huelga corresponde a las asociaciones simplemente inscriptas; sin embargo se omite el tratamiento del despido discriminatorio por motivos sindicales sufrido por el actor. El presente trabajo se sitúa en el marco de estudio de la normativa nacional e internacional sobre derechos humanos y tiene por objeto analizar las motivaciones, las líneas jurisprudenciales y las consecuencias prácticas del fallo. Se parte de la hipótesis de considerar que la decisión en tal sentido reviste carácter excepcional. Es una investigación cualitativa, analítica, documental, microsocial y de alcance temporal diacrónico, que busca, a través del estudio de los fallos de nuestro Máximo Tribunal, dilucidar si el pronunciamiento en cuestión podría resultar una contribución con el fin de impulsar la transformación del "modelo sindical argentino". Para ello la tesis explora: La libertad sindical (Capítulo 1); El modelo sindical argentino (Capítulo 2), El despido discriminatorio por motivos sindicales (Capítulo 3) y El caso Orellano (Capítulo 4).
