The work approaches the colonial period that goes from the eighteenth century until the approval of the provincial Constitution in the year 1854, and leaves aside looks back that apply to this stage the parameters of the liberal State of the 19th century. Also, it analyzes the transition from jurisdictional and government culture in the hands of judges, to the organization of the province in the republican form, and pays attention to the future of administrative and judicial activities, whose unfolding promoted the political doctrine since the French Revolution El propósito del presente trabajo es revisar y analizar las instituciones encargadas del gobierno del agua en Mendoza, cuya supervivencia siempre dependió de los ríos de la cordillera de los Andes. Se aborda el período que transcurre desde el siglo XVIII hasta la sanción de la Constitución provincial de 1854, evitando realizar una lectura desde los parámetros del Estado liberal tal como estuvo configurado a fines del siglo XIX. Se analiza el paso de la cultura jurisdiccional de Antiguo Régimen, consistente en un gobierno de jueces, a la organización de la provincia bajo la forma republicana, atendiendo particularmente al devenir de las actividades administrativa y judicial, cuyo desdoblamiento promovía la doctrina política desde la Revolución Francesa.
